A father must make a living with his children. Allah Ta’ala says:
Men are based on women with what God prefers some of them than one and from what they built from their money
“Men are leaders for women, because God plays some of them compared to others, and because they provide a living from their wealth.” (QS. An-Nisa: 34).
Allah Ta’ala also says:
To be spent with the capacity of his capacity and anyone who can live on it, let him spend what God has given, and God does not require money for God’s soul easily.
“Let those who are able to make a living in accordance with their abilities. (QS. Ath-Thalaq: 7).
From Abdullah bin ‘Amr bin Al-Ash Radhiyallahu Anhu, that the Prophet Sallallaahu Alaihi Wa Sallam also said:
Enough sin to make someone come
“It is enough that someone is said to be guilty if he wasted his dependents.” (Hours. Abu David no. 1692, Ibn Hibban no. 4240, refreshed by al-Albani at Sahih Abi David).
From Jabir bin Abdillah Radhiyallahu Anhu, Prophet Sallallaahu Alaihi wa Sallam said:
Start with your soul, and you will believe it, so if there is something that is preferred, then your family will disappear
“Start from yourself, you make a living yourself. If there is more then for your family. If there is more then for your relatives.” (HR. Muslim no. 997).
And it is mandatory for a father to make a living with his son in general. Ibnul Mundzir Rahimahullah said:
And all people who keep him away from science people gather, according to people who are people who are the best of children who do not have money. And that human birth is some of them, and that is one and his father, so when he has to spend himself
“The scholars who we memorize their opinions agreed that a man is obliged to support his small children who do not have wealth. Because the child of someone is a part of him, the child is part of his father. So as he is obliged to support himself and his family, he is also required to support himself and part of him (ie his child).” (Al-Mughni, 8/171).
Definition of living
Siblings or Nafaqah to provide adequacy in the form of tree clothing, tree food and residence to those who are obliged to bear.
In the book Majma ‘Al Anhar (1/484), Book Fiqh HanafiNafaqah’s definition is mentioned:
It does not stop the survival of something from time
“Something that is continuing something that is upheld on it, such as food, clothing, and a place to live.”
In the Fathul Qadir Ibnu Hammam (4/287) also mentioned the definition of Nafaqah,
Control is for something with what is on his feet
“Providing for something that can make it remain and take place.”
In the Ad-Durr al-MukhtarBook Fiqh Syafi’imentioned:
It is food, essence, and residence
“Making is food, clothing, and high places Ar-Raddul Mukhtar3/572).
In the Al-Fiqul Muyassar (1/337) also mentioned:
And legally: the adequacy of those who protect it well, clothing, residence, and dependence
“Syar’i, Nafaqah means giving adequacy to people who are dependent on ma’ruf in the form of quotes (tree food), clothing, residence, and derivatives of these three things.”
If we examine the words of the scholars, then we will find them defining that the living is inseparable from 2 things:
1. A living is something that makes the party that is given a living still exists. So the living for the wife is to give something (cause) that keeps the wife alive, healthy and awake as humans should. In other words, living we can call primary needs.
2. Lusts are generally in the form of three things: food, clothing, and residence. These three things are based on the argument of syar’i and also agreed upon every person who is a human primary need.
Is the school including a living?
After we know the definition of living according to the scholars, it is clear that school fees do not include a living. Then a father originally is not required to provide or provide school fees for his child. The fatwa of the Islamic Fatwa Council states:
University academic costs are not included in the benefits because
“The cost of education at the university is not included in the coverage of a mandatory living for children.” (Fatwa Islamweb NO. 75270).
Shaykh Khalid bin Abdul Mun’im Ar-Rifa’i said:
O Dear daughter, do not include university study fees in mature benefits, so your father is not required to pay university fees from your brothers, especially because you mention that the father is unable
“O girls, the cost of college education at the university is not included in the income that is mandatory for the father. Then it is not mandatory for your father to bear your brother’s tuition fees. Moreover if he is unable.” (FATWA ALUUKAHNO. 104061).
However, it should be noted that a father is obliged to provide religious education to his son. Allah Ta’ala says:
O Those of you who believe, protect yourself
“O believers, take care of yourself and your family of hellfire whose fuel is human and rocks.” (QS. At-Tahrim: 6).
In the book Riyadhus ShalihinImam An Nawawi Rahimahullah titled Chapter:
CHAPTER That his family and famous children must be ordered and other than those in his flock to comply with God Almighty and forbid them from violations and disciplined them and prevent them from doing their actions from them
“The compulsory chapter (for a husband) to order his wife and children, and all the people who are responsible for making compliance with Allah Ta’ala and forbid them from all deviations and must regulate them and prevent them forbid religious issues.”
Ibn ‘Abdil Barr Rahimahullah said:
It is mandatory for every Muslim to teach their families about their needs from their religious problems and order them, and it is obligatory for him to forbid them from everything that is not permitted for them and stop them and prevent them from it and teach them all of this from this from this from this all of this from this from this from this and this
“It is mandatory for every Muslim to teach their families the religious cases they need and are obliged to order them to carry it out. It is also obligatory to forbid them from everything that is not halal for them and keep and prevent them from all of that. And must teach them all of this (orders and prohibitions).” (Al-Hostidzkar510).
Likewise, a father must educate his child so that they can live a good life. Because the core of the provision of a living is to provide cases that keep their children alive well. This includes general education that allows children to live well.
And a father will be asked about the care and care of his son. From Abdullah bin Umar Radhiyallahu Anhuma, that the Prophet Sallallaahu Alaihi wa Sallam said:
All of you are a shepherd, and all of you are responsible for his parish, Imam is a shepherd and question about his parish, and the man is a shepherd in his family, and he is a person who is a sponsor in his husband’s house and a question about his parish and his parish
“Every time you are the person responsible. Every time you will be held accountable. A priest is the person responsible and will be held accountable. A man is responsible for his family and will be held accountable. A woman is responsible for affairs at her husband’s house and will be held accountable.” (HR. Al-Bukhari no. 893, Muslim no. 1829).
In conclusion, a father is not obliged to provide or provide school fees for his son, unless requested by the government. But what is obligatory is to provide education to children. And education is not synonymous with schools. So if a father provides or provides school fees for his son, this must be worth a large gift. From Abu Hurairah Radhiyallahu Anhu, the Prophet Sallallaahu Alaihi wa Sallam said:
Four Dinars: Dinar I gave him the poor, the dinar I gave him in the neck, the dinar that you spent for God, and the dinar that you spent for your family; The best you spend on your family
“Four types of dinars: the dinar that you give to the poor, the dinar you give to free boys, the dinar you have in the way of God, and the dinar you have for your family, most importantly for you for your family.” (Al-Bukhari Jam Di Al-Adabul Mufrad 578, al-Albani is defined Sahih Mufra AdabilD).
And assume that a father wants to make his son can adapt to his ability and not hopefully in debt. Because there are so many hadiths of the Prophet who tell about the dangers of debt. Among them is the hadith of Abdullah bin Umar Radhiyallahu ‘Anhu, the Prophet Sallallaahu Alaihi wa Sallam said:
Anyone who dies and has a debt, then it is not dinar or dirham, but it’s good and bad
“Anyone who dies in a state of debt, then (on the day of assessment) there is no dinar and dirham to bring down it. But only there is good or bad (to drop it).” (Hours. Ibn Majah no. Ash-Shahihah NO. 437).
Especially if the debt in question is by usury, while usury is a big sin. Then it should send the child to school must be adjusted to the ability.
